Recent Developments in the Extraordinary Chambers of the Courts of Cambodia: September 2018

On August 16, 2018 the two co-investigating judges at the Extraordinary Chambers in the Courts of Cambodia issued two competing orders in their investigation of charges against Ao An, an 85-year-old former Khmer Rouge commander.

The Extraordinary Chambers in the Courts of Cambodia’s Cambodian co-investigating judge, You Bunleng, is seeking to dismiss the charges, while the international judge, Michael Bohlander, seeks to send an indictment to the Extraordinary Chambers in the Courts of Cambodia’s Trial Chamber on charges of genocide and crimes against humanity.

This briefing paper summarizes the competing orders, considers likely next steps in the case, and places the result in the context of the political blockages facing the work of the tribunal.

The Open Society Justice Initiative has been monitoring the proceedings at the Extraordinary Chambers in the Courts of Cambodia since 2006 as part of its support for accountability for atrocity crimes.
