The Impacts of Strategic Litigation on Custodial Torture
In November 2015 in Istanbul, the Open Society Justice Initiative convened a meeting of some 40 litigators, judges, activists, torture survivors, policy analysts and legal scholars from Kenya, Argentina, Turkey and elsewhere to discuss the preliminary findings of a field-based research report on the impact of strategic litigation in relation to custodial torture. Cases examined seek to hold perpetrators of torture accountable, provide redress to victims, and prevent torture in the future. The participants examined comparative examples from Argentina, Kenya and Turkey and how to maximize the value of the forthcoming study. This document is a summary of broad conclusions and of several illustrative case studies.
